the legal argument here is that ICE agents wearing masks while conducting enforcement operations could fall under the disguise provision of 18 USC 241. the statute does say two or more persons going in disguise with intent to prevent the free exercise of rights is a federal crime. the counterargument the government would make is that uniformed federal agents with badges and identification are not operating in disguise within the meaning of the statute even if they wear face coverings, and that the statute was written to address situations like the Klan not routine law enforcement. whether that legal theory holds up in court is a different question than whether the statute exists. the text is real. the application argument is genuinely contested and would require a court to sort out.
