𝗦𝗶𝗿 𝗕𝗲𝗻𝗲𝗴𝗮𝗹 𝗡𝗮𝗿𝘀𝗶𝗻𝗴 𝗥𝗮𝘂 – 𝗧𝗵𝗲 𝗙𝗼𝗿𝗴𝗼𝘁𝘁𝗲𝗻 𝗣𝗶𝗼𝗻𝗲𝗲𝗿 𝗼𝗳 𝗜𝗻𝗱𝗶𝗮’𝘀 𝗖𝗼𝗻𝘀𝘁𝗶𝘁𝘂𝘁𝗶𝗼𝗻 Sir Benegal Narsing Rau (commonly known as B. N. Rau) was a distinguished Indian civil servant, jurist, scholar, and diplomat whose meticulous legal mind laid the foundational blueprint for the #Constitution of India. Although his name isn’t as widely celebrated in public memory as some other leaders, his contribution to India’s constitutional history is both profound and indispensable. Early Life & Education Born in 1887 in Mangalore (then part of British India), Rau came from a family with strong educational roots. He graduated with top honours from Presidency College, Madras, and later continued his studies at Trinity College, Cambridge, where his brilliance was widely recognised. During his time in Cambridge, his contemporary Jawaharlal Nehru described him in a letter back home as “frightfully clever.” Career in the Indian Civil Service Rau joined the Indian Civil Service (ICS) in 1910, at a time when very few Indians successfully passed this rigorous examination. He served in various judicial and administrative roles, developing deep expertise in law and governance. His ability to shape legislation and statutory frameworks came to the fore over decades of service. In recognition of his contributions, he was knighted by the British government in 1938. Constitutional Adviser to India’s Constituent Assembly When India attained independence in 1947, the newly formed Constituent Assembly needed a working draft of the Constitution to begin its deliberations. Although not a member of the Assembly itself, Rau was appointed Constitutional Adviser on 29 August 1947. Drawing on exhaustive study and comparative research, Rau travelled to the United States, United Kingdom, Canada, and Ireland to consult constitutional experts and judges, gathering global precedents to inform #IndianConstitution. In just about eight weeks, he prepared the first full draft of the Indian Constitution by October 1947, containing over 240 articles and 13 schedules. This draft provided the structural foundation for subsequent work by the Drafting Committee. Role in Shaping Key Constitutional Concepts -Rau’s draft didn’t just compile provisions; it also influenced enduring constitutional principles. For instance: He advocated that fundamental rights should be enforceable, so citizens could approach the Supreme Court – a principle that later became Article 32, often called the “heart of the Constitution.” After discussions with U.S. jurists, he recommended replacing the phrase “due process of law” with “procedure established by law”, which shaped how India’s judiciary relates to legislative power. Although the Drafting Committee chaired by Dr. B.R. Ambedkar would further refine, expand, and transform Rau’s draft over nearly three years of debate and deliberation, Ambedkar himself acknowledged Rau’s foundational contribution in the Constituent Assembly. Later Life and Legacy After the Constitution was adopted in 1949, Rau continued his distinguished career on the global stage. He served as India’s Permanent Representative to the United Nations and later became a judge at the Permanent Court of International Justice at The Hague, one of the highest judicial positions held by any Indian. He passed away in 1953, but his legacy remains embedded in the very architecture of India’s constitutional democracy.
