I have asked @grok and maybe europeans have the chance of getting their money back if @Tesla doesn't release any form of FSD (unsupervised). As we can see, HW3 cars have a version of it in the US. If the regulators in the EU choose only to give AI4 cars the license, IMO Tesla would be free of charge. They could tell their customers: "Sadly the regulators are not happy with the capabilities of HW3, so we can't deliver it. But as our loyal and precious customer we give you the chance to transfer one last time to a new AI4 car." The disclaimer in europe had some specific points, which makes it easier for Tesla IMO. "You must always supervise...it does not make your car autonomous yet" "...depends on software development..." (which could be impossible with that hardware) "Reliability isn't guaranteed (BETA)" So they seem to have "promised" a supervised system, when regulators allow it.

Die Antwort vom ASTRA ist leider etwas enttäuschend. Sie schreiben, sie konzentrieren sich „primär auf Stufe 3“ und können Stufe 2 plus nicht empfehlen. Dabei verstehen sie offenbar nicht richtig, wie gut Tesla FSD Supervised schon heute ist. Laut Tesla ca. 7x sicherer als der Durchschnittsfahrer. Für echte Level-3-Systeme brauchen die Hersteller aber zuerst reale Fahrdaten. Ohne Zulassung von Level 2 Systemen wie FSD gibt’s keine Daten und somit kein Level 3
