The Judiciary and Government are separate, the States Assembly is not the Government, it is the islands legislature.

Deputy Mézec makes an interesting point, he argues that removing the Bailiff from the States Assembly and having an elected speaker will cost the Jersey Taxpayers less money. However would it? Firstly, by removing the Bailiff from the States his focus would turn solely to the courts, he would therefore spend more time presiding over cases in the Royal Court. The Carswell report highlighted the amount of days he spent in the Royal Court and Court of Appeal, this would obviously increase and therefore the cost of his legal expertise would not decrease because of him leaving the States Chamber. (His salary would remain the same) Secondly, an elected speaker would require staff, an office both figuratively and literally, it has been suggested that the States Greffe would be able to support the speaker from existing resources. We disagree, the States Greffe have grown exponentially in the last 5-10 years, now totalling 64 staff we see no reason why this wouldn’t happen further with an elected speaker. The cost of the Speakers office in the United Kingdom is £1,709,000 (23/24), this does not include legal advice. We don’t believe an elected Speaker for the States of Jersey will cost the same as the United Kingdom but it will be a significant increase on what is currently spent by the Bailiffs Chambers on facilitating the Bailiff in his capacity as President of the States. Summary: We believe replacing the Bailiff with a speaker will cost the taxpayer more money, particularly as time goes on and the role inevitably develops.
