Remember that time Nestlé tried to steal rooibos tea? Rooibos only grows in one place on Earth, the Western Cape, particularly in the Cederberg region. Nowhere else. Not Europe. Not Asia. Not the Americas. Just there. In 2010, not satisfied with poisoning babies for decades, Swiss food giant Nestlé filed multiple patent applications attempting to claim the health and cosmetic uses of Rooibos. Yes, a European corporation tried to patent the uses of a plant that is indigenous to South Africa, has been used for generations by local communities, and forms part of their traditional knowledge system. Educated people call such brazen extraction of biological resources for private ownership and profit, biopiracy. Or audacia specimen-snatchia et impudentis scientiae imperium in Latin. Fortunately, the SA government refused the brown envelopes and briefcases full of US dollars and rejected all five patent applications. There was probably a language barrier during the “negotiations”. Then in 2019 the government formally recognised Khoi and San communities as custodians of the traditional knowledge surrounding Rooibos. Under the agreement, they are entitled to 1.5% of the annual value of unprocessed Rooibos sold and the funds go toward cultural preservation, education, and social development. This was a reminder that colonisers don’t just come with ships and flags anymore. Sometimes they come with patent filings. And always with briefcases. Also, the fact that it’s even called “rooibos” is itself a form of colonialism. I don’t speak Khoi or San, but I’m certain they don’t have that word in their indigenous lexicon. But that’s another story.
