There are a lot of unanswered questions about the general license just published. Are we going to see statutory waivers for a wide range of laws passed by Congress over many years, which are all implicated here? Or is this an attempt to gut the core statutory sanctions architecture? Will FAQ guidance be issued on this? Absent more information, it certainly appears on its face to many to be written in a manner that provides maximalist concessions to the IRGC, including potential direct financing of terrorists. And, of course, Treasury cannot license away the FTO status of the IRGC, which poses criminal liabilities. Are we heading toward a delisting of the IRGC from the FTO list?
