Some of these petty fights will reverberate very soon. If they genuinely had financial constraints, my thinking is that @KalondoMonica would have volunteered to suggest cuts herself, she can afford to so assist the state should the need be. Oto Afraida Kaana komuBorni! 🤔

CORRECT!

@Shipululo The Doctrine of Legality exists precisely to ensure that power is exercised within the law, not above it. A democracy that cannot answer procedural questions without drama should interrogate why the procedure feels threatening. Abracadabra is not governance.

Storm in a Cup of Tea. We didn’t demand “Secrets” or any “classified” information, FIRSTLY. Secondly, there is no single claim that the President does not take such decisions or asked her to explain anything. What has been raised are Procedural questions, based on the Doctrine of Legality, as provided for by the Constitution - Factual Legal Questions. The Storm in a Cup of Tea has nothing to do with our questions. We are not Posturing or seeking to be liked/thanked by anyone, More so by a President seemingly introducing a Doctrine of Abracadabra to our young nation 🤘🏿👍🏿

There is imaginary thinking that Presidents or PM of nations explain their decisions they don't it's Prerogative to fire and hire. By asking them to is task them to declassify sensitive info which they used to arrive at decisions. Nowhere is it done as proposed just populism.

If you FAILED and did not hold PREVIOUS Presidents and Governments ACCOUNTABLE in the Past when you had a chance to do that, it has NOTHING to do with US. We were in Primary/High School leading our peers . We are here NOW and we take our work seriously. ACCEPT this reality or step aside because we will not stop. History is a place of LEARNING and REFLECTION but NOT a place of RESIDENCE.

The Issue is more complex than that. Consider, for example, the Police Act also touches on the IG removal and details Audi. Second, you must ask yourself if there was someone (a Stranger in Law) present purporting to represent Parliament when they in actual don’t. Third, Police Act (Section 3B) sets out audi which didn’t. In any case, Section 6 (7) mandates record of the Commission, which record should be produced when so requires. Fourth, the matter of the Quorum (114 (3) ) is not at issue, Yet, yes YET. It is whether it was Lawfully constituted. It is Abracadabra whatever way you look at it. Indeed, Abracadabra!
Monica Geingos@KalondoMonica

@Shipululo The boring part is that as long as there was a majority of members, their decisions are valid even if there is a vacancy. The exciting part is due process is never boring. The funny part is the doctrines of abracadabra. All three can be true at the same time.

People of Namibia 🇳🇦 I am in Berlin for National Interest duties and only just catching up on the developments relating to the Inspector General of the Namibian Police. Let’s clarify a few things: FIRSTLY, the Inspector General of the Namibian Police is appointed by the President on the recommendation of the Security Commission, as provided for by Article 32(4)(c). SECONDLY, The President can only suspend the Inspector General of the Police after consulting the Security Commission, as provided for in Section 4(1) of the Security Commission Act, Act No. 18 of 2001. THIRDLY, The Security Commission must include two (2) Members of the National Assembly, as provided for in Article 114(2) of the Namibian Constitution and Section 3 of the Act. Without these two (2) Members, the Security Commission is not lawfully constituted. Any decision taken by a Security Commission without two Members of Parliament is a NULLITY in terms of the Principle of Legality.I can inform the country, as a Member of Parliament and as the AIC of AR (the third largest party in the National Assembly), that as a matter of fact, the 8th Parliament (National Assembly) has NOT assigned and/or submitted any Member to the Security Commission. It therefore stands to reason that the doctrines of abracadabra, legality, and functus officio could be invoked. Off to my last meeting of the day. Let’s discuss later!
