A court interpretation is raising questions about “careless driving” as a charge, suggesting it may not exist as a standalone offence in law, but is instead covered under broader traffic provisions, the gap btwn enforcement language & legal wording is now under sharper scrutiny.

Under Article 25(c) of the constitution, the right to fair trial is a non-derogable right. So how can the court make quasi constitutional excuses on amorphous grounds in its refusal to set aside the impeachment of Hon Rigathi Gachagua? The Gachagua judgment in my humble opinion is on a shaky, shallow, soggy and sandy soil.

Upholding an impeachment & still finding rights violations & awarding KSh 50 million raises questions about consistency in justice. It suggests a precedent where breaches are compensated rather than fully invalidated, instead of the impeachment being declared null & void.

The court declined to make a determination on the specific amount sought, noting that it was not properly before it in the proceedings. However, the judges held that Gachagua is entitled to remedies for constitutional violations & awarded him KSh. 50M in constitutional damages.

Breaking: Rigathi Gachagua stands impeached!

Issue No. 7 of 7 : Fair Trial High Court determination: The court found that the right to a fair hearing was violated.

Rigathi Gachagua Impeachment Issue No. 1 of 7 : Jurisdiction High Court : The court has jurisdiction to hear and determine the petition. However, the high court declines to venture itself into the merits of the impeachment being a political process.

Issue No. 6 of 7 : Constitutional Processes High Court determination : The court held that constitutional procedures were substantially complied with, but noted additional concerns it will not rigidly tie itself to at this stage.

The Court has now turned to what is arguably one of the most contested and extensively debated provisions arising from the impeachment of Rigathi Gachagua: the interpretation and application of Article 145(3) of the Constitution.
