
𝗛𝗼𝘄 𝗜 𝗗𝗲𝗳𝘂𝘀𝗲𝗱 𝗮 𝗙𝗮𝗺𝗶𝗹𝘆 𝗕𝘂𝘀𝗶𝗻𝗲𝘀𝘀 𝗗𝗶𝘀𝗽𝘂𝘁𝗲 𝗧𝗵𝗮𝘁 𝗪𝗮𝘀 𝗗𝗮𝘆𝘀 𝗔𝘄𝗮𝘆 𝗙𝗿𝗼𝗺 𝗟𝗶𝘁𝗶𝗴𝗮𝘁𝗶𝗼𝗻
One of my earliest lessons in law didn’t come from a courtroom. It came from watching a family dispute nearly destroy their business.
𝗧𝗵𝗲 𝗽𝗿𝗼𝗯𝗹𝗲𝗺
Two sibling business partners were on the brink of suing each other.
Upon review, I realised that the problems went deeper than control over the business.
- Assets weren’t clearly divided
- Roles were undefined
- Sibling rivalry turned every discussion into a personal attack
If we went to court, the business would inevitably collapse, and the family bonds would too.
𝗖𝗼𝗺𝗶𝗻𝗴 𝘂𝗽 𝘄𝗶𝘁𝗵 𝘁𝗵𝗲 𝗿𝗶𝗴𝗵𝘁 𝗶𝗻𝘁𝗲𝗿𝘃𝗲𝗻𝘁𝗶𝗼𝗻
Realising that going to court was a guarantee of a lose-lose situation, I decided to reframe the process.
During pre-trial negotiations, I:
1. Shifted the focus from grievances to shared goals
2. Made an argument for a restructuring, with clear roles, responsibilities, and succession planning structures in place
𝗧𝗵𝗲 𝗼𝘂𝘁𝗰𝗼𝗺𝗲
The dispute de-escalated. Instead of filing suit documents in court, we worked on a framework for long-term governance.
The business stabilised, and the family ties survived.
