@ThisSukxT_T I mean more, if someone has an assault case, they are probably gonna hope that the assault ends up considered rape, and if more people think what happened is rape, they have a better chance the judge will. I dont think we will likely change the legal def of rape anytime soon

@SplendidSpeseia Within the legal sense that’s what happens. Calling everything rape doesn’t make it any more serious in the eyes of the law. If anything it continues to harm people because their assault is seen as inferior to an already inferior crime.

@SplendidSpeseia @kymerekal There’s a nuanced conversation here of sexual violence in relation to forced puberty and where the line is there. But puberty in itself, as a bodily function, is not rape. Your body is not raping you for changing it’s a different horror. They deserve to be different.

@ThisSukxT_T I think in the legal case what maters more is getting as much legal coverage for as many assault victims as possible. Outside of that context, I am happy saying all sexual assault is not rape

@SplendidSpeseia People are saying that forced transition as a whole is rape. That having to go through puberty as a trans person is rape. And while rape CAN be involved in forced transition, it’s important to recognize forced transition as its own form of sexual assault that can include rape

@ThisSukxT_T Well it helps a lot legally for the prosecution of those crimes, since even the most extreme of the legal definitions of sexual violence "rape" hardly ever gets prosecuted, let alone "lesser" kinds. Otherwise we have a hierarchy of sexual violence where only some get legal help

@SplendidSpeseia How does it help you to make rape a broad thing instead of recognizing different types of sexual violence. Rape doesn’t have to be the biggest worst thing someone can experience ever. Other types of violence should be respected as their own and just as bad.

@ThisSukxT_T Okay so what are we arguing about then? Taking away HRT can be considered sexual assault like you said. What else does a forced puberty mean? It's either, taking away a trans persons hrt, or it means forcible injections of cross sex hormones

@SplendidSpeseia For anyone to take away a trans persons medication would be grounds for sexual assault because it is denial and action. Tho I would argue more often than not it falls under physical assault/intention for harm but I won’t argue against there being times it’s sexual assault.

@ThisSukxT_T Right, well, it's not rape in this intance because it feels like rape, it might be because they were actually raped. Some things are seperate in appearance, but meet a core definition. Everything is not rape, but forcing a puberty via any intentional means, probably is

@SplendidSpeseia Something can feel like rape and not be raped that’s what we’re trying to say. Most trans people have been raped we know the comparison of assault and dysphoria/transphobia. It’s a horrible thing but they’re also seperate things. Why does rape have to be everything.

@ThisSukxT_T And those effects, according to many, felt like rape, some don't feel the same, kinda like how some woman don't see their boyfriends choking them without asking as sexual assault, sometimes the same action in different people won't always create the "I was raped" response

@ThisSukxT_T The exchange of assault took place when the parent took the meds away from the child. It occurred when the parent cancelled the child's endo appt because they feared they would prescribe HRT. The effects of puberty cause a different kind of trauma when it is forced vs otherwise

@ThisSukxT_T Maybe we need to define denial further as well. Is it denial, if a doctor prescribes HRT, and the parent takes that medication away from them? Or is it only denial if the parent doesn't actively try to give the child the medication, but doesn't try to stop the child either

@ThisSukxT_T So I can see a lot of people being like "my parents didn't rape me, they are still deep down good people" and the harsh reality is that "good" people can still rape you, and you can still form a "good" relationship with your rapist

@ThisSukxT_T Why not though? When on paper it meets the definition of sexual assault? Maybe the reason it is hard to imagine, is that we are way too used to parents doing this to children. And many of those kids grow up and have good relationships with those same parents

@ThisSukxT_T If the parent refused to book the child's appts, but the child can legally be shown to have been able to book those appts theirself, that might be an edge case where willfully removing access might be considered by courts to be merely medically neglect

@ThisSukxT_T See I would say that, in the category of forced puberty, which may or may not be rape, that one of the exceptions for it being rape would be that it was due to the general neglect of the child's needs, rather than as purposeful denial of the medication.
