@SMMcMinimee but of course they’d have to believe he had the final say and not “the board and jim” as the execs insist so yeah definitely more complicated than just that detachment factor but it certainly doesn’t help their argument that they’re doing what’s best for the sport.

@SMMcMinimee Ah that makes sense. I agree it will definitely make the jury wonder how/why he doesn’t know those things. I do wonder if his general detachment will lead the jury to infer he doesn’t know what’s best for the sport anymore and made decisions that protected his ownership above all

Probst is on the stand now, and the one notable quote I picked up on is that he said when OEMs join the sport, it causes the other OEMs to renegotiate better terms for teams to try to keep them. This is the complete opposite strategy NASCAR’s defense has said the sanctioning body would do if there were a rival stock car series.

@Jacobdean1342 It’s certainly a big point but I think there’s a lot more to the case than just this testimony. It’s a complicated case and juries can be unpredictable especially when they may not understand everything in as much depth as we do.

@StreetLegalPod idk about you but for all the grilling the teams & denny hamlin have received i honestly can’t recall it going this badly for them so far. like yea denny was humbled & 23xi has been shown-up factually a few times but at least it sounds like they’ve been able to remain competent!

& if you throw out the section 1 claim now, the risk the 4th Circuit (who has historically been somewhat confused by this case) gets rid of the charter system on appeal or something crazy is gone.

okay i see people struggling section 1: REQUIRES conspiracy or agreement i.e two or more people/entities agreeing to do something anticompetitive (most if not all of the NCAA cases). It’s broader than section 2, typically less technical economic analysis involved.
