He withheld payroll taxes from employees at his nursing homes across 11 states but never paid them over to the IRS (2017–2018); he also failed to file required 401(k) reports. He was sentenced to three years in prison in April 2025 and served only about three months before the pardon. - In April 2020 at Andover Subacute and Rehabilitation Center II in New Jersey (a facility previously operated under Skyline and to the Schwartz family via his son Louis). During a COVID-19 outbreak that killed at least 70–83 residents, authorities discovered 17 bodies crammed into a tiny makeshift morgue designed to hold only 4–5. The bodies were in bags, stacked and overflowing; the facility was later fined over 200,000. At least three families won multimillion-dollar wrongful death lawsuits against Schwartz/Skyline facilities for neglect-related patient deaths, but they have collected nothing due to the chain’s bankruptcy and asset shielding. He also had a separate Arkansas state conviction for Medicaid fraud/tax evasion tied to inflating rates at his facilities. A judge sentenced him to three years in federal prison in April 2025; he began serving it and had served only about three months when pardoned.
