Minnesota NEEDs to deploy the National Guard on a mission of “maintaining the peace between ICE and protestors” It BLOCKS Trump from nationalizing. The Insurrection Act requires that the State has “failed” or “refused” to engage in protections. The Guard CANNOT be nationalized while responding to that same mission. The difference here is the way the Governor would instruct “maintaining peace” is dramatically different than Trump. The Governor would also have oversight control and accountability over the States National Guard forces. If you fail to call them up, it gives Trump grounds in the legal battle.
