The arrest of Muwanga Kivumbi has once again sparked debate about politics, free speech, and the rule of law in Uganda.
Many Ugandans still remember the Butambala events during the elections, the legal cases that followed, and his campaign remarks about the President that drew criticism. His release yesterday on bail in a serious murder case also raised questions among many citizens about how such decisions are made.
Now, after He makes fresh remarks about the President, the First Lady, and Gen. Muhoozi, and boom Kivumbi has been arrested again. While freedom of speech is guaranteed, he appears to have miscalculated the current political climate, where outspoken political figures have faced swift legal and political consequences.
The bigger question remains: where should the line be drawn between legitimate political criticism and speech that may attract legal action, and are these standards being applied consistently to all political actors?
Uganda needs a political space where citizens can speak freely, but also understand the realities and sensitivities of the current political environment.

@TMweeri @KwikirizaNova @NUP_Ug the NCF is shared by NRM because of the numerical strength but since it's in the law NUP has been participating, in parliament they sit with the NRM coz it's legal, so the consistence here is that NUP falls the law and that's why they had to make the iPod statutory to coarce nup.

I felt the need to clarify the issue of NUP and IPOD because of the amount of misinformation and misunderstanding I continue to see on this platform.
To begin with, IPOD was not originally created by law. It was registered as a company limited by guarantee and was funded by the Netherlands Institute for Multiparty Democracy (NIMD).
At the time, NUP declined to join IPOD because there was no law compelling it to do so, and the party did not agree with the objectives for which IPOD had been established.
It is important to note, however, that NUP has been a member of the National Consultative Forum (NCF) since it gained parliamentary representation. Under the law, all political parties represented in Parliament are required to belong to the NCF, which is a statutory body. Membership also entitles parties to receive public funding, with allocations determined by their parliamentary representation.
Last year, the Minister of Justice and Constitutional Affairs, @norbertmao, issued a statutory instrument giving IPOD statutory status. One of the key provisions was that any political party wishing to continue receiving public funding must also be a member of IPOD.
The implication is that NUP, as an opposition party represented in Parliament, is now legally required to join IPOD if it wishes to continue receiving government funding. Failure to do so would affect its eligibility under the new legal framework governing access to public funds allocated to political parties.
Whether one agrees with the policy or not is a separate debate. However, it is important to distinguish between the legal position and political opinion.

That does explain the legal basis for participation. But now were questioning the issue of consistency. You're sitting with the same dictator you accuse of killing ugandans, looting ugandans, now you're sitting with him on the same table sharing billions of taxi payers money and then after you come and start telling Uganda that "Tumutwala" ?

NUP has been a member of the NCF from day one because for it was in the law. now they made IPOD a subset of The NCF where NUP is already a member. hope this can help you
