As y’all ran away from reparations and towards illegal immigration and obfuscation, they redrew the maps. Mind you, this has been the play since the War on Drugs. You can’t incarcerate your way out of reparations, then wonder why the base done pulled up. 🤷🏾♀️

Under very few circumstances will I ever support the expansion of federal authority. State legislatures are fully capable of establishing bipartisan redistricting commissions on their own. States such as Ohio, Michigan, Arizona, and Virginia have already done so. For the record, I’m not in favor of gerrymandering, but I also understand the legal and constitutional complexity of imposing a nationwide ban given that elections are largely administered at the state level.
On another note, I’m calling it a night. I appreciate the dialogue and although we don’t agree, this remained respectful and that’s rare today. Much respect to you!

The redistricting of the congressional map is a direct assault on the voting rights act. There’s a bigger fix needed that’s so much bigger than the “Black athlete”. The NAACP “Out of bounds” initiative does have a historical foundation though. I’m torn because young people have often led the most impactful movements, but we can’t lay this solely at the feet of those athletes.
We have to respect that college athletes now have a chance to impact generations of family members. There needs to be a focus on the total plan to affect change, & that begs the question… “What will others sacrifice to take a stand?”.

The Constitution largely entrusts redistricting decisions to the states, not the federal judiciary or Congress acting as a national mapmaking authority. State legislatures own the primary responsibility for determining the time, places, and manner of congressional elections, subject only to limited federal oversight. Redistricting has always been a political process, and political considerations in map drawing are not inherently unconstitutional.

That distinction only matters if you assume the legal process itself is free from political motivation or selective application. Court approval does not automatically make an action principled or nonpartisan. Legislatures and political actors routinely pursue strategies that are technically lawful while still designed to produce a political advantage.

@TenPointPG @DaymeDaymes @Realrclark25 New York in 2024 was mid decade. New Mexico was mid decade (although still in litigation). And I live in Maryland and Maryland has routinely attempted aggressive redistricting off cycle but has remained quiet after court intervention in 2022.

Yes it is. Listening to oral arguments and reading the opinion would explain that. That footnote is a matter of data interpretation that had no bearing on the opinion by the majority. The opinion was not based on voter turnout statistics but relied heavily on the unconstitutionality of face based redistricting, a requirement to prove intentional discrimination, and the idea that partisan explanations often overlap with racial voting patterns. Even if you removed this footnote, the majority opinion would have been the same because the framework was laid in the Shelby County case.

This ruling did not go far enough. At some point, the Supreme Court should decline to hear gerrymandering or voter discrimination claims brought under the Voting Rights Act, effectively limiting its role in this context, and instead evaluate these cases solely through the lens of the 14th and 15th Amendments. Case law from the VRA has been an absolute mess.
