The horror at Suitability Gardens! A thread: What was meant to have been a trip filled with palpable euphoria for expats returning home ended up being an experience that candidly mimics scenes from a horror movie. #TheHorrorAtSuitabilityGardens

@MxolisiBob I do not know. Your guess will be as good as mine. Hopefully, the picture will be clearer as the matter progresses.

So why is the government not spending over 80% of its legal services budget on Mashishi & Makhani Inc? Who is stopping them?
Thato Mashishi™@ThatoDM

@MxolisiBob One of the reasons is the failure to appreciate consolidation as an approach within the black community, but that is a topic for another day. The opposition by the firms stems from the possible impact on their bottom lines since they generate a lot of fees from the government.

@pete_carswell @AardvarkBloody Those firms employ more blacks at junior levels, but that is not translated into partnership. How else do you explain the attrition rate without seeing it as a systemic exclusion? Have you heard of the firm TGR? Clients do not necessarily follow departing black lawyers.

@ThatoDM @AardvarkBloody If there was a systematic exclusion of black partner-level lawyers then would see them existing firms and starting new ones. Their competence would mean that they would have clients follow them and we would see an abundance of exclusively black owned firms. But we don’t see it?

They say it takes 10 to 11 years for one to make partner. Considering that they have always known this, 50% black ownership should have not been an issue. South African universities produce more black graduates and the firms themselves typically recruit more black junior staff.

@pete_carswell @AardvarkBloody Touché Peter. That is not a new consideration. The same firms had to consider that at the dawn of democracy when a lot of black lawyers were elevated to partnership. At the heart of the conversation is the systemic exclusion of blacks.

@ThatoDM @AardvarkBloody Making it to equity partner isn’t about your ability to do good work. It’s about your ability to bring in good work. This isn’t a universal skill. Equity partners are added when existing equity partners see value in an individual not just because the calendar page has turned

@ThatoDM Why can’t we organise and build our own ecosystem though? Why are we fighting a private sector system to include us? The judiciary is more than 55% black, what’s stopping us from building as well?

@ThatoDM Government shifting the BEE goalposts on law firm ownership. The big firms want to keep their stake, the black lawyers want in. It's about eating. Both are steadfast in their virtuous arguments.

@AardvarkBloody You do know that partner promotions are an annual occurrence right? Transformation should be included amongst those considerations. It is that simple.

@ThatoDM Attorneys do not automatically become partners and the firm determines whether more partners can be added, at a given time. There is limited work, for too many lawyers, anyway and it would be ridiculous to simply add new partners to serve an existing client-base.

@Thabiso_Sib @ThatoDM Yeah same with Strategy & Management Consulting in Consulting, especially Strategy. Mainly pushed to "service" roles, tech support & such. You dare try to push the ladder back down as the "only black leader" who made it through & it won't be long till you're shown the door.

Why can't we see a "Mofokeng & Sibiya Inc" which is 10 times bigger than Norton Rose? Who is stopping that advancement ? Must we bicker about white people and the parasitic institutions that have built for the next 10 generations?

It is imperative that we meticulously examine the practice areas into which black legal professionals are being advanced at those firms. Commercial litigation and employment cannot be the only fields demonstrating progress in this regard.

@ThatoDM I’m always interested in seeing the demographics of candidate attorneys retained in their Corporate & Commercial + Banking & Finance departments. I don’t even get shocked anymore. They continue to strategically move black legal professionals away from those fields.
