THIS TUESDAY, THE POLITICALLY CONTRIVED CYBERCRIME TRIAL OF SENATOR Sen Chijinkem Ugwuanyi In ENUGU STATE MUST BE BROUGHT TO AN END BY THE ACTING INSPECTOR-GENERAL OF POLICE, @TunjiDisu1 . Our comrade brother, Sen Chijinkem Ugwuanyi, has been unjustly remanded in prison following a coordinated effort by the Nigeria Police Force, Enugu State Command, and the state government to silence him by arresting and unlawfully charging him under the Cybercrimes (Prohibition, Prevention, Etc.). Act, reportedly relying on Section 24(2)(a)(b). For many of us, this is precisely the kind of conduct that led to sustained opposition against former illegal IGP Kayode Egbetokun. Under his leadership, the police force, in our view, became increasingly prone to political misuse, functioning less as a protector of citizens and more as an instrument deployed against Nigerians. I am therefore calling on Acting IGP Tunji Disu to immediately discontinue the trial when proceedings resume on Tuesday. The Commissioner of Police in Enugu State, who initiated this prosecution, should also be relieved of duty immediately, effectively. Sen Chijinkem Ugwuanyi is said to have been accused of offending the Enugu State SSG, Prof. Chidiebere Onyia. Yet the legal foundation of the charges is deeply flawed. Section 24(1)(a) and (b) of the Cybercrimes Act 2015 has been amended. Under the current law, it is ONLY an offense to transmit messages via computer systems that are either pornographic or knowingly false for the purpose of causing a breakdown of law and order or posing a threat to life. How does calling out a public official lead to these bogus charges? The alleged conduct does not meet these clearly defined statutory thresholds, so therefore, the prosecution lacks a lawful basis, and the case must be discarded. #FreeChijinkemNow
