@thehill Of course, predictability in the application of law is, contra Sotomayor, a very good thing. But the fulcrum of predictability should be fidelity to written law and precedent, not the judge’s politics.

@thehill Ironic coming from perhaps the most predictable justice on the court. I can count on one hand the number times she’s surprised me. Ask “what outcome would the average elite liberal want in this case,” and Sotomayor will reliably vote that way.

New: The American Bar Association for the first time during President Trump's second term in office has rated one of his judicial nominees as "not qualified," bestowing that label on Katie Lane, his pick to become a federal judge in Montana. reuters.com/legal/governme…

@nateraymond Yes I noticed. The question is: are their accusations founded (yes), which you hid. And you allowed liberal readers to dismiss the accusations by framing them that way (intentionally?). Either way, poor work on your part.

@ThereBeJudges I didn't mention any studies but I did write: "Conservatives have long accused the ABA of bias against Republican judicial nominees."

@nateraymond Can you also explain why you didn’t mention any of those studies in your article?

@nateraymond Can you explain to your readers why they should care about the ABA’s rankings, especially given multiple statistical studies showing systemic bias against nominees from Republican presidents?

Steve Vladeck totally misconstrues my invocation of general relativity, interprets my reply to critics as uncharitably as humanly possible, and somehow claims that I'm the one no longer entitled to a presumption of good faith. Just amazing. If you want to see what the Einstein thing is referring to btw, here it is, judge for yourself: papers.ssrn.com/sol3/papers.cf…
