The state hasn’t meaningfully opposed the appeal
The state has responded generically.
It’s not for the court to determine if it’s right or wrong, someone else will do that.
The sentence appeal enjoys the excellent prospects of success, there’s no judicial precedent on this.
The court thus has an opportunity to have a higher court re-look at it and come to a conclusion.
There are 4 cases the defence came with & none were reasoned to.
The state hasn’t presented any case in counter.

What has transpired is a ‘sad day for justice’ in bringing such a matter to court as it impacts the society.’ Inmates had to be returned to correctional services. Witnesses who lost family members had to be return home’

Why Julius Malema’s appeal will be successful:
State says that:
1. Snyman handed a gun to Julius Malema(gun presumed to be Snyman’s).
2. Malema fired live ammunition from that gun.
3. Snyman was negligent in doing so.
The court dismisses the section 174 application for both accused & says they have a case to answer to.
Malema answers his case & brings his own evidence(the toy gun).
Snyman refuses to answer his case, not even about the gun that he allegedly gave to Julius which is in the possession of the State but opts to bring experts which the court says were unhelpful.
However, the court acquits Snyman & convicts Malema.
In so doing the court is basically saying that Snyman did not hand a gun to Malema.
Now here are the two big questions that arise: Then whose gun did Julius Malema discharge & was it a real gun?
The answers to those questions are simply not before the court & if the answers are not before the court, how did this magistrate find that the State proved its case beyond reasonable doubt?

#CountryDuty #StatevMalema Magistrate: - it’s a concern for the court that a planned event led to a crime being commissioned. - The firing of shots cant be called celebratory, calling it otherwise, is sugarcoating - there can be no doubt that in the event planned led to 5 offences being committed. - it is clear that there was an intention of committing an offence. - it should take considerable planning that at what time will the accused fire the firearm. - this reflects a decision and intention to break the law - the decision to break the law was planned, and approved by the leadership. - accused knew the unlawfulness & proceeded to break the law. - such acts can’t be condoned by the court & court can’t justify this as celebratory shots. - insofar as other examples were made such as Pistorius, ‘my focus is on this matter, sorry’

@SethabileZ But if you training for any marathon or ultra that’s a very good route for training especially if you start Solomon at the Engine by Lintons Corner.

Ran my first ever 30km today and I definitely cried when I finished. Hhaybo it was so difficult 😭. Ran from Pretoria East , Olympus to Castle gate centre and back. Woah 🤣😭 #runningwithtumisole #running #LSD
