BREAKING NEWS: Operation Dudula challenges Zimbabwean Exemption Permits, in Court. On the 20 March 2026 Operation Dudula served a notice of motion on the Minister of Home following the illegal extension of the ZEPs on the 7 October 2025. The Zimbabwean Exemption Permits were set to expire on the 25 November 2025 but to everybody's surprise Minister Schreiber renewed them. OperationDudula challenges the extension of the Permits on the folliwng grounds: 1. The Minister was supposed to consult with the South African General public before making a decision to extend the Permits. The Minister did not do this. PAJA, Promotion of Access to Administrative Justice Act Provides that Ministerial decisions must be subject to public approval through submissions. 2. The Court Order of June 2023 gave the Minister 12 months to consult with interested parties before making a decision on the ZEPs. This Court order lapsed November 2024, the Minister had no authority to act on the Permits after expirey thereof. 3. The Zimbabweans Exemption Permits like any other permit must be applied for by the holder upon expiry. When the Minister Extended the Permits on behalf of Zimbabweans he acted unlawfully. 4. Operation Dudula also contends that the Zimbabwean Exemption Permits legalised people who were Illegal in terms of Section 49 of the Immigrants Act, which people were supposed to be Deported instead of being granted Permit. South Africans are waiting to see the reaction of the Minister following this applicatio.
