- No universal impairment threshold — Most states lack a standardized "per se" THC limit equivalent to alcohol's BAC rules, because scientific consensus on exact levels correlating to driving impairment is limited and inconsistent. Studies (including from NHTSA) show mixed results on whether marijuana alone significantly elevates crash risk, especially after adjusting for factors like age or alcohol use.
- Causation vs. presence — Crash reports (e.g., via NHTSA's Fatality Analysis Reporting System or state DOT systems) often distinguish between a drug being present and it being the actual cause. Officers or investigators determine contributing factors based on evidence like observed behavior, field sobriety tests, witness statements, vehicle dynamics, and other factors—not just toxicology alone. Marijuana may be noted as "present" or a secondary factor, but alcohol (when over the limit) is far more likely to be assigned as the primary cause due to stronger evidentiary links.
This approach can affect statistics: Positive marijuana tests may be underreported as causal factors or appear lower in "drug-caused" crash counts compared to alcohol, potentially skewing data on marijuana's role in accidents. Research shows marijuana positivity in fatally injured drivers has increased in some legalized states, but proving direct causation remains challenging.
In short, while testing happens and positives are recorded, marijuana is often treated more cautiously in official determinations of crash causation than alcohol due to these scientific and evidentiary limitations.
