Let’s talk about the mental health diversion law passed by our glorious CA legislature and signed into law by the Governor: Criminals who commit child abuse, domestic violence, attempted murder, torture, robbery, home burglary, elder abuse and many other crimes are eligible. The defense gets to come up with the treatment plan which can be out-patient (it does at some point need to be approved by the judge). There’s no probationary supervision. The defendant gets released from custody right away back into our community. After 2 years - the defendant gets the case dismissed and the arrest removed like it never happened. Once the case gets dismissed, the victim gets no protective order and there are no firearms restrictions - so if any firearms were removed from the defendant or his/her home, the defendant gets them back. What type of mental disorders qualify: anxiety; depression; alcohol abuse; meth addiction; heroin addiction; fentanyl addiction; marijuana addiction; adjustment disorder; almost anything mentioned in the DSM as a mental health disorder. Whatever mental disorder they choose, the law says it’s “presumed” that the disorder is a significant factor in the commission of the crime. The prosecution then has the burden to disprove this by clear and convincing evidence (which is nearly impossible to show). So, clearly CA is against protecting children, DV victims, the elderly and the community at large. And CA isn’t concerned with unstable people who commit crimes having firearms if their case is dismissed through mental health diversion. So, basically all our electeds are against public safety. What should happen: mental health diversion has an important place in our criminal justice system. However, many of these violent crimes need to be excluded from this law. It needs to be in-patient treatment with actual supervision to protect the public. The victim must also have rights - to be able to get a criminal protective order and restitution, and firearms restrictions must be applicable. Lastly, the defense should have the burden to prove the mental condition was a significant factor in the crime, not the prosecution having the burden to disprove that. How about pro-victim, pro-public safety legislation for once.
