The seller cancelled the contract and kept the deposit. The buyer argued that: • The agent told him it was OK to pay the deposit over two days 🤝 • Since the seller received the full money, the contract should still stand But the Queensland Supreme Court rejected that argument, ruling: • The deposit deadline was an “essential term” of the contract 📑 • The agent had no authority to extend the deadline 🚫 • Paying late meant the buyer breached the contract • The seller was legally entitled to keep the entire $98,500 deposit 💸 📚 The legal principle In property contracts, especially in Queensland: ⏰ “Time is of the essence.” If the contract says the deposit must be paid on a specific day, missing that deadline can allow the seller to: • Terminate the contract • Forfeit the deposit Even if the full amount eventually arrives. 🚨 Big takeaway for buyers Lawyers say this case is a clear warning: • Never rely on verbal or text messages from agents about changing contract terms 📲 • Any change to a deposit deadline must be formally agreed to by the seller ✍️ • Or written into the contract 📄 Because in property… What someone says 🤔 and what the contract says 📑 …can be $98,500 apart. 💸 #realestatecontracts #realestatelaw
