Notably, the "insult" provision under section 9(1)(a) appears to have no enforcement history. The only criminal case opened under the Act concerned non-compliance with a subpoena, not expression. This warning is unprecedented in its reach.

Contempt doctrine exists to protect the process, not the individual decision-maker. Its purpose is to ensure matters are decided fairly, institutions function effectively, and the rule of law is upheld. It does not extend to insulating public bodies from legitimate criticism.

The Public Protector's office has warned that "insulting" the institution could lead to a R40,000 fine or 12 months' imprisonment. The legal basis for this warning deserves scrutiny. 🧵 enca.com/news-top-stori…
