KTN is reporting that Ksh 500M recovered from the homes of the four KPC suspects have vanished from police custody. It's reported that the senior thug who resides at Statehouse ordered the money to be delivered to him. It's very clear that this was a case of junior thugs stealing without sharing the proceeds of crime with the senior thug. Other countries have mafias while in Kenya, a mafia has a country.
The illogical basis @IMFNews is arguing that it must be maintained on immunity in Kenya: ⭕️ IMF was established under the Bretton Woods Articles of Agreement (July 1944) ⭕️ Kenya accepted these Articles via the Bretton Woods Agreements Act (10 December 1963) ⭕️ Section 5 of that Act gives the Fund Agreement force of law in Kenya ⭕️ Article IX, Section 3 of the Fund Agreement grants IMF full immunity from every form of judicial process ⭕️ Immunity can only be waived by IMF itself — it has not waived it here ⭕️ Filing this motion does not constitute a waiver of immunity Archives Protection ⭕️ Article IX, Section 5 makes IMF archives inviolable ⭕️ Any court order compelling disclosure of IMF documents would violate international law, the Bretton Woods Act, and the Fund Agreement itself The Ask ⭕️ IMF should be struck out as the 6th Respondent entirely in @OkiyaOmtatah ⭕️ Time to file a response should be suspended pending that determination ⭕️ Costs awarded to IMF ⭕️ The lawyers for #IMF are jokers: They are saying no Kenyan court has jurisdiction over it — full stop.
