Justice delayed is justice denied. Jamaica’s Justice System is in crisis. Let me use a Covid related case to illustrate. Claim filed in 2021. Claim amended January 2022. Matter argued June 10th, 2024. Judgment handed down 16 April 2026. Near two years passed between oral arguments and judgment. And over 2 years between the amendment of the claim and the actual hearing. This is not an exception. This is normative. Another example from a Covid related case. Claim filed May 2022. The AG on the other side. Through no fault of the Claimants who were prompt in their conduct, the matter came on for hearing April 2025. Parties still awaiting judgment. There is a systemic crisis. Among the things I have never understood is why are only the litigants required to follow strict timelines? Failure to comply could mean prejudice to clients. Why are there no timelines for judges to hand down their decisions? There is a crisis in our Justice System. Lengthy delays are normative. Sometimes it may be the fault of individuals but a big part of the problem is how the system is configured and the absence of timelines for judges to deliver judgments.
