What actually separates review and appeal? Mainly origins, procedure, the possibility of rehearing on appeal, and remedies. But substantively there is not much difference.

I have a new draft paper up: “Appeal vs Judicial Review: Myths and Surprises”. papers.ssrn.com/sol3/papers.cf…. The orthodoxy in English public law is that appeal is more extensive or broader than judicial review. I argue that this gets things backwards.

@TimJSayer That’s helpful thanks. I definitely agree on 2 and 3. Not sure about 1 because I think a lot of those cases are about failures to follow a statutorily prescribed procedure/meet some prescribed condition. And that seems to me to fall under the ground of illegality.

@TimJSayer That’s interesting! Do you think courts are mostly dealing with questions that are not about grounds of review at all, or that they are dealing with questions that are about grounds but ones which tend to be neglected in the literature?
