@ReichlinMelnick Brignoni Ponce is no longer good law in the Ninth Circuit as to the use of race in stops. The Ninth Circuit rejected it in light of changes in law and demographics in Montero Camargo. It has reversed removal orders where race was used. See Sanchez, Gonzalez Rivera, Orhorhaghe.

Remember, the Border Patrol is expressly authorized to racially profile people under generations-old Supreme Court precedent from an era where the Hispanic population of the US was much lower. Massively expanded enforcement will mean more situations like this.

@MichaelGKagan Good point re ER expansion. The Trump admin tried that last time. The ACLU repped Make the Road in a suit against it on APA and DPC grounds. They won an injunction on the APA (by then-Judge Jackson!), the DC Circuit rev'd it, and then the Biden Admin rescinded the expansion.
