Today, SCOTUS unanimously reversed the 5th Cir.'s application of the Heck bar in Olivier v. Brandon. Heck, which prohibits certain civil claims that would collaterally undermine a criminal conviction or sentence, does not apply to (most) claims for injunctive relief. But...

Olivier v. Brandon is a case (by the great Alyson Ho at @gibsondunn) challenging the 5th Cir.'s absurd application of Heck v. Humphrey to injunctive relief. A street preacher was fined. The 5th Cir. held he could never enjoin the unconstitutional law because he paid. But @IJ...

Victory for Afroman over the sheriff's deputies who sued him for defamation and invasion of privacy through false light. "In all circumstances, the jury finds in favor of the defendant. No plaintiff verdict prevailed. So the matter will be concluded with defense verdicts."

Hey @MeatEaterTV, some of us out here are not overlooking game wardens' supposed authority to rely on the open fields doctrine. Some of us, in fact, are challenging that power in courts across the country--and winning! ij.org/press-release/… I'd be happy to come on the pod and chat in-depth about this issue. Just say when!
MeatEater@MeatEaterTV

A lot of folks overlook the fact that game wardens are allowed to enter private property without a warrant, unlike standard police officers. This law opens a can of worms, and it’ll be interesting to see if it’s adjusted in the years ahead.

Sometimes the most effective amici are the surprising ones. Magicians Penn & Teller (with the UT Clinic) just filed an amicus brief for a Texas death-row prisoner convicted partly on “hypnotically enhanced testimony,” arguing it’s the same technique they use to trick audiences.

The government can't create courts where bureaucrats play prosecutor, judge, and jury. @WSJopinion offers support to @IJ's latest case on behalf of a small farm against agency courts:

The Missouri Food Truck Freedom Act, HB3157, had its first hearing today, and we had some great local food truck owners join me in Jefferson City to testify in support! Thanks to sponsor Rep. Mike Jones and our partners at @AFPMissouri for all their work advancing this bill.

Hello hater who just makes stuff up about our cases and dumps on them. The state doesn't require anyone doing this type of work full-time for a company to have a license. The state is only insisting that he be licensed because he is doing part-time contract work. This case right now is about whether the government has to actually explain to a court how its rule protects health and safety. Learn something then maybe argue about it for a change.

Today, the Arizona Supreme Court heard arguments in our case on behalf of engineer and entrepreneur Greg Mills. For more than 30 years, Greg designed, analyzed, tested, and built electronic circuits for everyday consumer products. After decades of doing this work as an employee, he started his own consulting firm to help startups and small businesses with product engineering. But Arizona’s licensing laws say the same work Greg could do as an employee becomes illegal when he does it for himself. This case asks whether the state can impose sweeping licensing and speech restrictions that prevent experienced professionals like Greg from earning an honest living. ij.org/case/arizona-e…

The Court's recent opinions in Mirabelli were head-scratchers when it comes to substantive due process. I explore all that and how Meyer and Pierce are also economic liberty cases. Does that mean there's more economic liberty coming to SCOTUS? ij.org/cje-post/subst…

ALPR cameras misread the "7" on Brandon Upchurch's license plate as a "2" leading police to pull him over and sick a dog on him that mauled him. But the cops and the private companies that run these cameras insist their "safeguards" work. They don't. businessinsider.com/flock-safety-a…

Today, @IJ filed an amicus brief at SCOTUS urging it to scrap pro-censorship rules in circuit courts that allow blatant First Amendment retaliation ... so long as it's not *too* much. These pseudo-amount-in-controversy requirements have no basis in the Constitution or statute. 🧵
