I’ll keep saying my view: punishing students for having and expressing views disfavored by the current presidential administration is an inexcusable betrayal of academic freedom and free speech. It chills speech and teaches students the exact wrong lessons about public discourse.

Ohio colleges are staying silent as at least 49 international students lose their visas — some after joining campus protests, attorneys say. cleveland.com/politics/2025/…

I agree. And what made the case fascinating was its inversion of the structural defect anti-SLAPPs fix: long, stressful cases exact a toll on defendants even when claims are dubious. Here, the process became the punishment for *plaintiffs* due to steady stream of satirical vids.

Unfortunately for Afroman, this case was filed before Ohio enacted its Anti-SLAPP law—these days, this case likely would have resolved in a matter of months (not years), and required these officer plaintiffs to pay Afroman’s attorneys’ fees.

@NewsyOhio18235 depending upon exactly how plaintiffs pleaded their case, before Anti-SLAPP I could see it going to the discovery/summary judgment phase, but some of the testimony showed that the Court did a poor job of gatekeeping purely legal issues like opinion and substantial truth

From everything I could tell about this case, it should have never made it to trial. In my view the statements I saw mentioned were clearly not actionable as a matter of law, and the case probably should have been dismissed in n summary judgment (if not sooner).

Victory for Afroman over the sheriff's deputies who sued him for defamation and invasion of privacy through false light. "In all circumstances, the jury finds in favor of the defendant. No plaintiff verdict prevailed. So the matter will be concluded with defense verdicts."

@NewsyOhio18235 @winemedineme ACLU has the MTD decision up: #legal-documents" target="_blank" rel="nofollow noopener">aclu.org/cases/cooley-v… -- dismisses some of the publicity claims, but the defamation analysis is very conclusory (and NB the very relaxed pleading standard in Ohio at the time)

@winemedineme @andy_geronimo If you can get copies of the actual motion/decision, that would be great but don't know how easy that'd be in Adams County.

One other thought: an (unfortunate) example of how juries can be an effective check on government overreach/indifference. This case should never have been filed, and when it was, it should've been dismissed; the jurors did what the judicial system wouldn't.

The Ohio Supreme Court recently said Superintendence Rule 12 requires judges to permit broadcasting in open trials, and that R.12 "does not authorize judges to decide for themselves who has a legitimate voice" re trial publicity In re Wollscheid ¶¶ 66-7 supremecourt.ohio.gov/rod/docs/pdf/0…

Update: after a gentle nudge from your humble reporter, we have a copy of the jury's question. It is quite a salient question for those familiar with the facts here.

Journalists widely reported on the deposition videos of former DOGE staffers because they're important and newsworthy. Ordering them removed can't be squared with the First Amendment. The court must lift this unconstitutional prior restraint. abcnews.com/Politics/group…
