An employer has been ordered to pay over Ksh 16M as compensation for the death of an employee in the course of employment. The court found that the employee’s death, though caused by a criminal attack whereby the employee was fatally shot, was still connected to his duties and occurred in the course of employment. As such, it qualified as a work injury under the Work Injury Benefits Act (WIBA). The employer had reported the incident and failed to challenge the Director’s assessment within the prescribed timelines, making the compensation award lawful and binding. Attempts by the employer to avoid liability were dismissed, with the court emphasizing that once an injury or death is work-related, the employer bears responsibility regardless of third-party involvement. The petition challenging the compensation was ultimately struck out, and the employer remains liable to settle the full amount.
