First of all, sweetheart, *I* never said anything about this being Silent Whispers' fault in any of my tweets regarding the campaign to bring Valko back. So dunno why you're targeting me for this. BUT SINCE YOU BROUGHT IT UP... Separately, I would like to point you to some sources that talk about the past existing lawsuit between the two companies, where Silent Whisper's parent company (Archosaur Games / Zulong Tianjin) committed trademark hijacking and infringement against Papergames and then subsequently *lost* that law suit and ended up withdrawing their countersuit. So when you see people SPECULATING they may have something to do with the current issue, there's decent reason for that speculation, because there is a well-known, well-documented history there. Origin of the Dispute: Keyword Placement Sparks "Traffic Hijacking" Controversy Going back to January 2024, Papergames discovered through monitoring that when Zulong was promoting its self-developed mobile game "Code Name: Shining" (《以闪亮之名》) on the WeChat advertising platform, it had set Papergames' registered trademarks—including "Shining Nikki" (闪耀暖暖), "Infinity Nikki" (无限暖暖), and "Miracle Nikki" (奇迹暖暖)—as search keywords. This operation caused the system to prioritize displaying Zulong's game ads when users searched for these keywords on the WeChat platform, objectively causing some users to be confused and mistakenly believe the two games were related. In light of this, Papergames formally filed a lawsuit with the People's Court of Suzhou Industrial Park in March 2024, accusing Zulong's conduct of infringing its exclusive trademark rights and constituting unfair competition, and demanding that Zulong immediately cease the infringing conduct, compensate for economic losses, and clarify the facts through public channels to eliminate the adverse effects. Courtroom Confrontation: Zulong's Defense Refuted by Platform Evidence During the trial, Zulong offered a defense regarding the conduct at issue, claiming that the relevant keywords had been set by an outsourced advertising placement company, and that there might have been automatic matching by the WeChat advertising platform's algorithm, asserting that it had no subjective intent to infringe. However, this claim was quickly overturned by a "Statement of Facts" issued by Tencent, the operator of the WeChat advertising platform. In its "Statement of Facts," Tencent explicitly confirmed that the keywords at issue—"Shining Nikki," "Infinity Nikki," and "Miracle Nikki"—had all been actively added to the advertising placement system by Zulong, and that the platform had not edited or interfered with the keywords in any way, thereby completely ruling out the possibility of automatic technical matching. After hearing the case, the court held that Zulong had, without authorization, used Papergames' registered trademarks as search keywords to promote its own game, which was likely to cause consumer confusion, and that its conduct therefore constituted trademark infringement. At the same time, the conduct fell under the "misleading promotion" prohibited by the Anti-Unfair Competition Law and constituted unfair competition. On March 31, 2025, the People's Court of Suzhou Industrial Park issued its first-instance judgment, ordering Zulong to compensate Papergames a total of 150,000 yuan for economic losses and reasonable expenses. It is worth noting that this type of "traffic hijacking" through the covert use of setting a competitor's trademark as a search keyword is more concealed than the overt infringement of directly misappropriating a trademark, posing considerable difficulty for the rights holder's evidence-gathering efforts. After the first-instance case was filed, although Zulong voluntarily took down the relevant ads, it subsequently filed a countersuit against Papergames on the grounds of unfair competition. Final Ruling: Papergames Wins Across the Board, Zulong's Withdrawal Ends the Dispute In August 2025, the Jiangsu Provincial Intermediate People's Court held the second-instance trial of the case. After reviewing all the evidence, the court issued a final judgment upholding the original first-instance ruling, once again clearly finding that Zulong's conduct constituted trademark infringement and unfair competition, with the 150,000-yuan compensation amount unchanged. However, after the judgment took effect, Zulong failed to fulfill its compensation obligation within the prescribed period, so Papergames applied to the court for enforcement, and enforcement proceedings have now been initiated.
