What @DHSgov won’t tell you is that ICE was arresting people at court even when their cases HAD NOT been completed. There were people who dutifully showed up for their court hearing, had a scheduling conference, were told to come back later, and then were handcuffed immediately.

It is commonsense to take illegal aliens into custody following completion of their removal proceedings. Nothing prohibits arresting a lawbreaker where you find them. We are confident we will ultimately be vindicated in this case.

Years ago, during Trump’s first term, I described this approach to immigration law as finding the “hidden weapons.” They were good at it then, they’re both better and more reckless with it now; the legal pretexts have gone from flimsy but defensible to egregiously wrong.

The "Control-F Monarchy" rolls on It continues to be useful to think of the Trump administration as an exercise in finding and using random statutes to create kingly authority for the White House. I had no idea that the executive branch could just create a $2b pot of money to dole out to friends. But this administration continues to offer a masterclass in weaponized esoterica.

Nearly 12,000 habeas cases filed is a staggering amount, something not seen in generations. And for the government to lose 86% of the time, in front of hundreds of judges appointed by every living president, is a sign of just how much ICE and DOJ stretched the law until it broke.

Immigration judges issued more than 80,000 "voluntary departure" orders from January 2025 through March 2026, at least 7x the number issued in the final 15 months of the Biden administration. "Voluntary" is doing a lot of work in that phrase.

When I was in law school, a job at the DOJ was considered one of the best and hardest-to-get jobs in the entire field. Now the DOJ has been forced to extend $25,000 signing bonuses because so many people have quit and lawyers with integrity aren't applying for any jobs.

There is now a 3-2 split against the Trump admin’s claim that a 1996 law secretly mandated the detention of potentially millions of undocumented immigrants living here for years. The 2nd, 6th, and 11th circuits said that was wrong, while the 5th and 8th agree with the admin.

Legal immigrants are losing their jobs and their legal status not because THEY did anything wrong, but because the GOVERNMENT refuses to adjudicate the applications they paid for and filed. It should be a massive scandal.
