Over rechtstatelijkheid: De Nederlandse grondwet wordt vaak gepresenteerd als een waarborg van vrijheid. Vanuit ons libertair perspectief is ze dat niet. Ze is een handleiding voor staatsmacht, geen schild voor burgers. In tegenstelling tot de Amerikaanse grondwet is de Nederlandse niet gebouwd op wantrouwen tegen macht, maar op vertrouwen erin. Dat verschil is fundamenteel. De Amerikaanse grondwet erkent rechten als onvervreemdbaar. De staat mag ze niet schenken of afnemen. De Nederlandse grondwet erkent rechten als gunst die de overheid mag beperken wanneer ze dat “in het algemeen belang” acht. Vrijheid is dus niet absoluut, maar afhankelijk van politieke meerderheden en beleidswensen. Een recht dat afhankelijk is van toestemming is geen recht, maar een privilege. Eigendom is in Nederland niet heilig. Artikel 14 stelt dat de staat mag onteigenen in het algemeen belang. Dat betekent dat eigendom uiteindelijk toebehoort aan de collectieve macht, niet aan het individu. Belastingen en regulering kunnen vrijwel onbeperkt worden opgelegd. In de VS daarentegen is eigendom verankerd als een fundamenteel recht. Onteigening kan alleen onder strikte voorwaarden en met compensatie worden afgedwongen. Het recht van de burger komt daar voor het belang van de staat. De Nederlandse grondwet kent geen structurele rem op staatsgroei. Er is geen plafond op uitgaven, geen beperking van overheidsomvang, geen constitutionele plicht tot begrotingsdiscipline. In de VS zijn macht en bevoegdheden beperkt door een federale structuur en checks and balances die elke uitbreiding van staatsmacht tot een politiek en juridisch gevecht maken. De Nederlandse staat daarentegen groeit met elk kabinet, zonder dat de grondwet daar ook maar iets tegen inbrengt. De bescherming tegen meerderheidsdwang is in Nederland zwak. Een parlementaire meerderheid kan vrijwel elk recht beperken of uithollen. De rechter mag niet toetsen aan de grondwet, want artikel 120 verbiedt dat. Er is dus geen constitutionele muur tussen burger en staat. In de VS vormt rechterlijke toetsing een krachtig schild tegen tirannie van de meerderheid. Burgers kunnen hun overheid juridisch terugfluiten. In Nederland kunnen ze hooguit stemmen, hopen en klagen. De geest van de Nederlandse grondwet erkent de staat als bron van legitimiteit. Ze beschrijft de monarchie, de regering en het parlement als fundamenten. De burger is niet het uitgangspunt, maar het object van regelgeving. De Amerikaanse grondwet daarentegen begint met drie woorden die alles zeggen: We the People. Daar is de staat een instrument. In Nederland is de staat een gegeven. Een libertariër ziet een grondwet niet als ceremonieel document maar als slot op de deur van staatsmacht. De Nederlandse grondwet is geen slot maar een handleiding voor de sleutel. Vrijheid is geen gunst. Eigendom is geen collectieve voorraad. Rechten zijn geen beleidsopties. Een echte grondwet begrenst de staat, niet de burger. Wie vrijheid serieus neemt, moet dat verschil erkennen. Wat Nederland heeft is geen constitutioneel schild. Het is een systeem dat vrijheid slechts tolereert zolang het de staat goed uitkomt. Bitcoin is technology to empower anyone, regardless of their race, education, wealth, or geography, to peacefully resist the overreach. It may still be controversial today, but I truly believe bitcoin will go down as the most important technology invention of our lifetime. We owe so much to Satoshi Nakamoto.
