The accused was detained by virtue of a warrant of arrest issued by the court. Therefore, the restraint on his liberty was lawful from the very beginning. It cannot be assailed through the remedy of habeas corpus. Under Rule 102, Section 4 of the Rules of Court, a writ of habeas corpus is not allowed if a person is in custody under process issued by a court or judge with jurisdiction. A writ of habeas corpus may be denied even if the detention was illegal at its inception, provided that certain supervening events occur before the application for the writ is filed. The legality of a detention is evaluated at the time of the filing of the application for the writ. Even if an initial arrest was warrantless or otherwise illegal, the restraint of liberty can become legal through issuance of a warrant, order, or other formal judicial process, or filing of a complaint or information. The filing of an Information or the issuance of a warrant serves to "cure" the initial illegality of an arrest for the purposes of a habeas corpus proceeding.
