High Court Refuses Request to Refer Alleged Perjury to DPP and Jails Enoch Burke’s Mother and Sister for Courtroom Contempt The High Court has refused an application by teacher Enoch Burke to refer alleged perjury to the Director of Public Prosecutions and has sentenced his mother and sister to two weeks imprisonment each for contempt of court arising from disruptive conduct during a hearing in February 2026. The decision was delivered by Mr Justice Alexander Cregan on 4 March 2026 in proceedings brought by Burke against Sean O’Longain, Geraldine O’Brien and Jack Cleary, who had been members of a disciplinary appeal panel considering Burke’s dismissal from Wilson’s Hospital School. Burke was dismissed from the school for gross misconduct in January 2023 and appealed the decision through the school’s disciplinary appeal process. A disciplinary appeal panel was established to hear the appeal. Burke challenged the participation of one panel member on the grounds of objective bias and ultimately succeeded in that challenge in the Court of Appeal, which required the panel to be reconstituted. A second disciplinary appeal panel later held a hearing in December 2025. In January 2026 Burke issued High Court proceedings seeking to restrain the panel from continuing with his appeal and requesting orders that its members stand down. He also alleged that aspects of the process infringed his constitutional rights, including his right to cross examine witnesses. Before the case proceeded to a full hearing, two members of the panel resigned and the remaining member indicated that she would not serve on any newly constituted panel because the applicable rules prevented someone who had previously served from participating again. The court held that these developments meant Burke had effectively obtained the relief he sought, namely that the existing panel would cease and that any appeal would be heard by a new panel. As a result, the proceedings were struck out as moot. Burke also argued that affidavits sworn by Sean O’Longain contained false statements and asked the court to refer the matter to the Director of Public Prosecutions for investigation of alleged perjury. The judge addressed this argument in the second judgment and refused the application. The court held that the allegation arose from conflicting affidavit evidence between the parties. Mr Justice Cregan stated that it would be inappropriate to make findings about whether a person had lied on affidavit during interlocutory proceedings where the evidence had not been tested by cross examination. Since the proceedings had been struck out as moot and no plenary trial would take place, the court would not determine the issue or refer the matter to the DPP. The judge also noted that disputes about the accuracy of affidavits are common in litigation and that such matters are normally resolved through evidence at trial. He added that Burke remained free to refer the matter himself to An Garda Síochána or the Director of Public Prosecutions if he wished. The judgment also addressed events during the court hearing on 20 February 2026. During the hearing, Burke repeatedly protested while counsel for the school was opening an application for the school to be joined as a notice party. According to the court, Burke refused repeated directions to sit down. At that point, Burke’s mother Martina Burke and his sister Ammi Burke stood and began shouting loudly at the court and at counsel, repeatedly interrupting the proceedings. The judge stated that the level of shouting prevented him from being heard and caused the hearing to descend into chaos. Gardaí present in the courtroom intervened and removed both women from the court, while Burke himself was returned to Mountjoy Prison and the hearing later resumed remotely. The court subsequently invoked its contempt jurisdiction in relation to the conduct of Martina Burke and Ammi Burke. At a hearing on 25 February 2026 each was given the opportunity to respond to the allegation that their conduct constituted contempt in the face of the court. Both women criticised the court’s treatment of Enoch Burke and argued that his rights had been denied. The judge rejected those submissions, finding that their behaviour involved repeated shouting, refusal to comply with directions of the court and disruption of the hearing to such an extent that the proceedings had to be abandoned until order was restored. Mr Justice Cregan stated that maintaining order in courtrooms is essential to the administration of justice and that deliberate disruption of proceedings undermines the ability of courts to hear cases fairly. Having considered the circumstances, the court sentenced Martina Burke and Ammi Burke to two weeks imprisonment each for contempt of court. The judge also indicated that certain materials relating to Ammi Burke, who is a solicitor, would be sent to the Law Society for consideration of whether a disciplinary investigation should be initiated. The court further stated that it was considering directing that certain members of the Burke family attend future hearings involving Enoch Burke remotely rather than in person in order to prevent further disruptions.
