@joshquising There are actually different takes to a Bicol Express depending on which area of Bicol you’re in. There’s no “standard” Bicol Express.

@HayatoKusa17748 @rodmagaru In legal cases, opinions don’t really matter. Evidence does. Everything is speculative now until the parties have presented their respective evidence.
Gideon V. Peña@attygideon
@rodmagaru Of course all these would boil down to evidence: was there an agreement as to ownership? If there is none, the law is clear that it belongs to the creator.
English

If you’re an employee/talent of a show, and you create, write, draw, compose, suggest, —in short did that work that is required of you as an employee, who owns the right of your work? You or the company who employed you?
Because that’s how I see what’s going on with TVJ summoning TAPE & GMA Network for airing previous episodes of EAT BULAGA, who owns EAT BULAGA? TVJ who coined the show title or TAPE, the PRODUCER and CREATOR of the SHOW.
Help me, help us understand legal twitter. ✏️✏️

Is this a sign para magreview na ulit? Char! Hello po, @attygideon! Thank you for being an inspiration to all of us. 💜

@rodmagaru I think the latter diba. Otherwise, yung designer namin sa company, when he decide to resign someday, can he sue our company for using his designs after leaving? Parang di tama.

English

@rodmagaru In the course of the running of the show on TAPE, was there transfer of copyright ownership?
Section 180.2 of the Code says “the copyright is not deemed assigned inter vivos in whole or in part unless there is a written indication of such intention.”
English

@attygideon my point still stands. spec work in general is unethical, no matter how good the result was.
Cheers.

@kistymea Refer to this thread for exchanges of different povs. Feel free to add a different take :))
Gideon V. Peña@attygideon
@tumbke Then the remedy is to ensure that actors do not resort to unfair practices. Lobby for a law that will ensure that contests are held fairly, not that contests are not held at all.
English

@attygideon No, that’s an absolutely bad take because design contests are exploitative! It’s basically free labor.
PAGCOR knew what they were doing. They had a choice to hire reputable design agencies but they wanted to siphon the money through this “rebrand” project.
English

@danigorrrl Being passionate about something should not result in gatekeeping an issue. :))
English

@danigorrrl Thanks for sharing these. See? It’s possible to address issues without preventing people from commenting just because they’re not part of an industry. While we disagree on some matters, a rational conversation wouldn’t hurt.
English

@attygideon their process is corruption.
halata namang hindi sila dumaan sa proseso.

@danigorrrl No pros in a contest, like the Luneta monument design?
English

@danigorrrl “The correct creative process is to pitch for your work/agency. And even then you charge the client to pitch.”
Isn’t this the process that led to the awarding of the PAGCOR logo project?
English

@attygideon it's actually very wrong. not even intrinsically wrong.
There are no pros, nor cons.
The correct creative process is to pitch for your work/agency. And even then you charge the client to pitch.
I am very passionate about this topic, as I've seen majority fall for it.
