More people need to talk about offshoring instead of just the various visa systems that are being abused. The visas are a small part of the problem. Here is how companies offshore while claiming they only employ American citizens:
- Work with an Indian national to create a new corporation headquartered in India.
- The new company is usually named India, i.e. Microslop India.
- This company's charter includes an exclusive, binding contract with the American company.
- The company can only do business with the American company they are contracted with. If this contract is terminated, the Indian company closes its doors.
- The Indian company is not technically a subsidiary of the American company due to contract shenanigans.
- The American company pays them via the contract terms, then they acquire office space and employees using these funds.
- These Indian employees work for the Indian company, not the American one.
- These Indian employees have full remote access to the American company's software/infrastructure to do the work an American citizen would normally do.
- The American company has contracted work out to an Indian company, but they can still claim that they "only employ American citizens" since the Indians that work remotely are employed by India.
- Profit, I guess.
Source: I'm in upper management in a heavily-regulated technology sector in the US. I have been forbidden from hiring entry-level talent since 2018, and I've had to look in India BEFORE I can fight for approval to hire an American citizen.
