Months ago I wrote about a Google lawsuit that exposed how ChatGPT, Perplexity, etc. work.
This week Google suffered a huge defeat.
In the process, a federal court handed AI companies and businesses an important win.
The ruling also revealed something fairly important about the future of ChatGPT, Claude, Perplexity and broader AI search that SEO Stuff (seo-stuff.com) has been helping businesses with for more than a year.

A few months ago, Google sued SerpApi, accusing the company of bypassing its anti-scraping systems to collect and resell Google Search results at scale.
Google claimed SerpApi was sending hundreds of millions of automated search requests every day, and it also claimed SerpApi was bypassing SearchGuard, Google’s anti-scraping technology, through methods that included automated CAPTCHA solving.
Google tried to argue that bypassing those controls violated the anti-circumvention provisions of the Digital Millennium Copyright Act.
The court has now rejected that argument, at least when it comes to ordinary search results containing no copyrighted material.
For public search results without copyrighted content, the court ruled that SearchGuard cannot qualify as a technological protection for a copyrighted work because there is no copyrighted work being protected.
That portion was dismissed without permission to amend.
Basically, in other words, Google cannot simply place a technical barrier around public search results and then claim that bypassing the barrier automatically becomes copyright circumvention.

Google still has one narrow path forward, though...maybe.
Some search results contain licensed images, particularly inside Knowledge Panels.
The court said Google had not shown that SearchGuard was being used with authorization from the owners of those copyrighted images, which the law requires.
That portion was also dismissed, but Google has 21 days to amend its complaint and try again, so the broader case is not necessarily finished.
However, the most important part of Google’s original theory has already been rejected.
Scraping an ordinary public search results page does not become a DMCA violation merely because Google tried to block automated access to it.
This substantially limits Google’s ability to use the DMCA as a general-purpose weapon against companies collecting public search results.
SerpApi called the ruling a victory for an open internet, and the company specifically said it would continue supporting developers, AI companies, researchers and businesses that rely on public search information.
SerpApi's infrastructure can give software systems access to live search results, rankings, snippets, Knowledge Panels, shopping results, local results and other information pulled from Google.
There have also been credible reports connecting SerpApi-powered pipelines to real-time search experiences inside AI products.
That means this ruling could help preserve one of the pipelines AI systems use to find current information.
Google’s search index remains one of the most valuable information layers on the internet and AI companies need fresh sources.
They need pages that have already been discovered, crawled, evaluated and ranked, and they need trusted websites, clear entities, current information and content that can be extracted without ambiguity.
Public Google results provide a ready-made map of that information.
For businesses, the practical lesson is straightforward: appearing prominently in Google can influence much more than traditional organic traffic.
Your pages can become part of the source pool used by search APIs, AI retrieval systems, answer engines, research agents and other products built on top of public search data.
This is one reason the separation between “SEO” and “AI search optimization” has become increasingly artificial.
The same website can be discovered by Google, surfaced through a search data provider, retrieved by an AI system and then cited or summarized inside an answer.
Every step depends on whether the business has information worth retrieving.

SaaS nao da patente, até pode na verdade se tiver unido a um hardware.
SaaS tem marca, direitos autorais em toda sua estética e trade dress, que é a roupagem da marca, se confunde um pouco com a extensão da marca.
Patente pode ser uma invenção ou um modelo de utilidade.
O software é declaratorio, ou seja, ninguem vai analisar ele para saber se é ou nao novo. O registro dura 50 anos (loucura). Muita gente nem registra software pq da para proteger ele de outra forma.
Se vc conseguir arquivar e provar que tem aquilo desde uma determinada data e que concebeu daquel determinado jeito, ok. Se não, registre.

🚩UMA VITÓRIA DA ADVOCACIA DE MASSA MINEIRA!!!
✅Fim da marcação automatizada do TJMG nos processos dos advogados mineiros
Entenda o caso:
No início do ano, verifiquei que o sistema E-PROC do TJMG estava marcando automaticamente todos os meus processos com "Indícios de Litigância Abusiva".
Postei isso aqui anteriormente.
Uma completa arbitrariedade. Um absurdo. Um escândalo.
Sem qualquer análise humana e sem qualquer verificação da petição e dos documentos juntados, os processos de vários advogados de Minas estavam sendo marcados apenas pelo número da OAB.
Ou seja, os processos e os advogados já chegavam com a marcação de “indícios de litigância abusiva” para os juízes, o que explica muita coisa estranha que vinha ocorrendo.
Denunciei isso tanto aqui como no meu perfil do Instagram.
Formulei um Pedido de Providências junto ao CNJ PP 0003605-70.2026.2.00.0000 - processo integral no meu site, link abaixo:

Curiosamente, das 23 denúncias e consultas que fiz no CNJ, apenas esse pedido não foi sumariamente arquivado: permanece desde 09/06/2026 "concluso" para decisão. 🤷♂️
Em 06/06/2026, enviei ao TJMG um pedido de informações técnicas sobre o assunto, com base na LGPD (documento integral no meu site, link abaixo).

▶️Uma das minhas postagens no Instagram chamou a atenção do jornalista Cleber Lourenço, que fez uma matéria sobre o assunto em 16/07. O TJMG foi procurado, mas não respondeu.

▶️Resultado: verifiquei ontem que o TJMG parou de "MARCAR" automaticamente todos os processos de advogados de massa como "indícios de litigância abusiva".

▶️Ou seja, o TJMG se viu obrigado a cancelar a marcação ilegal: percebeu que o problema escalaria de forma exponencial e seria um escândalo (mais um) de proporções nacionais, uma vez que não existe nenhuma justificativa para conduta tão grave contra a advocacia.
▶️Não se calem. Se UM advogado consegue mudar algo tão prejudicial contra a classe, todos nós podemos. Imagine se nos unirmos.
Seguirei vigilante e peço que os colegas também fiquem. Em caso de arbitrariedades, não deixem de denunciar, de reclamar, de formalizar tudo.
