Another day, another precedent-setting ruling for DeFi. Today, Judge Failla dismissed with prejudice the Risley class action against @Uniswap Labs and @haydenzadams. The Federal charges had previously been dismissed, and today the various state claims are dismissed. Again, the premise is simple: “Plaintiffs’ theories of liability are still predicated on Defendants having ‘facilitated’ the scam trades ‘by providing a marketplace and facilities for bringing together buyers and sellers of Tokens[.]’ Though the claims have changed, the result is the same: Plaintiffs cannot hold Defendants liable for the misconduct of the unidentified third-party issuers.” To take my favorite quote from the last dismissal: It “‘defies logic’ that a drafter of a smart contract, a computer code, could be held liable … for a third party user’s misuse of the platform.” Read the opinion here: courtlistener.com/docket/6321327…

@tomwanhh @SteakhouseFi @gauntlet_xyz also a mindset thing. DeFi doesn't close and managing risk across 24/7 markets is a different beast to anything TradFi trains you for. Most TradFi firms aren’t built for it yet.

TradFi has distributions, but they are also facing challenges when it comes to changing from quarterly/daily -> real-time monitoring, analysis, allocation, and risk management.
Not all curators will survive: @SteakhouseFi and @gauntlet_xyz are the promising candidates here.

9/ Vaults handle the yield layer. Basket tokens handle the portfolio layer. Both are needed. The on-chain fund management stack isn't finished yet and that's exactly why we're here

8/ That's what we're building with ERC-7621. Any fund manager or ERC-4626 vault operator can launch a fully on-chain fund in minutes. The composition, rebalancing logic and fee structure all live in the token itself.

Bang on the money. It still amuses me when people ask me if it's all over. Only need to look at what has changed structurally since the last cycle and you'll see that crypto has never been stronger. Stablecoin laws, ETFs, mass RWA tokenization - TradFi is moving in to stay.
The stablecoin boom also = a fuck tonne of dry powder already on chain and ready to deploy. Never been a more important time to position well and with conviction.
