A debt collector is going to call your mom during your funeral
They'll tell her she owes $14,000 on your car loan.
She doesn't.
Legally your debt dies with you in most cases. But they bought your file for pennies and they know that most grieving families will pay a debt they don't owe just to make the calls stop
This is a real business model. There are companies that specifically purchase deceased consumer debt in bulk. They buy it for 1-2 cents on the dollar and then call surviving family members during the worst week of their lives
They'll say things like "we just need to settle the estate" and "you don't want this affecting your family's credit." Both are designed to make your mother think she's legally obligated. She isn't
Here's what the law actually says:
When you die, your debts go to your estate. If your estate has assets those assets pay the debts. If your estate doesn't have enough to cover everything the creditors eat the loss. Your mother, your wife, your kids, your siblings do not inherit your debt. Period
The exceptions: if someone co-signed the account they're on the hook for it. If you live in a community property state (Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, Wisconsin) your spouse may be responsible for debt acquired during the marriage. And federal student loans are discharged at death entirely
Everything else dies with you. That credit card balance, that medical bill, that personal loan. Gone. The estate handles what it can and the rest disappears
But the collectors won't tell your family any of this. Because a confused grieving person with a checkbook is the most profitable customer in the entire debt collection industry. There's no urgency like funeral urgency. There's no compliance like grief compliance
I talked to a woman whose husband died in 2024. Collectors called her 11 times in the first two weeks. She paid $23,000 across four accounts before she talked to anyone who told her she didn't owe a single dollar of it. The accounts weren't co-signed. Her state wasn't community property. She just paid because a man on the phone told her she had to during the worst month of her life
If someone you love dies and a collector calls:
Say this: "I am not the debtor. Send all communication in writing to the estate executor. Do not contact me again by phone." Then hang up. Under the FDCPA they must stop calling you once you request written communication only. Every call after that is a violation worth $1,000
Don't confirm any information. Don't say "yes" to anything. Don't give them a bank account number. Don't let them pressure a timeline. There is no deadline that matters more than protecting your family from predatory shit like this
