The Competition Tribunal is currently hearing four interlocutory discovery applications arising from the merger proceedings involving Pepkor Holdings Ltd and Shoprite Holdings Ltd (with Lewis Stores (Pty) Ltd participating as an intervenor). The applications collectively raise disputes concerning the proper scope of discovery before the Tribunal, the extent of the parties’ disclosure obligations and the limits of compelling further and better discovery in the context of merger proceedings. The Tribunal is hearing the submissions online.
