No argument there My only argument there is that he should have taken evasive action way earlier but then again that requires you to be paying attention and actually looking at what's happening a half a mile down the road He wasn't on a hill he didn't have some massive trailer in front of him blocking his vision He got lucky He looked up at exactly the right time and with maybe two seconds to spare he avoided running into a stationary object in the middle of the road. Again it's like jaywalkers You don't get to say well because the guy was walking across the road and it wasn't a crosswalk it's his fault that I ran him over... The other thing to consider here is not all modes share the same amount of risk. This trash hauler like most trash haulers probably has in abysmal safety record. And if this isn't distraction my guess is because he's a trash hauler it's fatigue. These guys are paid by the load and it's high pressure and it's hard work and they have to get as many loads as possible from 7:00 to 4:00 every day Monday through Friday and depending on how fast they do it It makes or breaks their check.
