@RobCurrieMusic I had one case where the accused could not return to Canada to face trial on outstanding charges because Citizenship and Immigration Canada refused to renew his passport...until he resolved his outstanding charges. The Crown conceded our s. 11(b) application.

Great reminder that if police charge you and get a warrant for your arrest – but don't then try to find and arrest you – the delay counts against the Crown: R. v. Folkes, 2024 ONCJ 506 <canlii.ca/t/k76rc>

@SewrattanLaw There is deference to the underlying factual findings that lead inexorably to the characterization of the period of delay, but not to the characterization itself. (I know, right?) The BCCA tried to sort out this Jordan standard of review in R v Virk, 2021 BCCA 58 at paras 8-24.

@SewrattanLaw Interesting how much the Court grounds its analysis in deference to the trial judge. My hope: Defence counsel can use Coates to argue for scheduling consecutive trial dates—instead of potentially earlier broken up dates—without giving up 11(b) rights. (1/2)
