Marc Elias sent out his Saturday newsletter: “The presidential race is over. Donald Trump won the presidency. Even more disturbing, he won the popular vote. Immediately, talk turns to why it happened. Then quickly, to the path ahead. The outcome of control in the House is still in the air. Put another way, there is still a path for Democrats to control a critical part of the federal government. Even if they fall short, Mike Johnson will face the same difficult path to governing with a tiny majority.  Democrats lost the Senate, but overperformed on every metric. They will hold at least 47 seats — having defied presidential gravity in Arizona, Michigan, Nevada and Wisconsin. Despite a premature call by AP, Bob Casey still has a path to win in Pennsylvania, where we have already seen Republicans file, and lose, litigation. The biggest question on peoples’ minds is what path our country is on. Have we forfeited American leadership in the world to Vladimir Putin? Did we trade in American democracy for the false promise of lower prices? Is rule of law a quaint notion for the history books? I’m not going to sugarcoat it. Tuesday was a very bad night for Democrats and for democracy. But…” But we can subscribe to Democracy Docket to read the rest and see that none of these fishy things are being investigated? Sigh.

I don't fault anyone for suspecting the guy, who was criminally indicted for trying to steal the 2020 election, might have stolen the 2024 election. You'd be naive not to suspect foul play. He is the architect of distrust in our institutions, the sower of doubt in our election processes, the catalyst of our national discord. Rather than spend endless hours pontificating on why he won, the media should spend their time verifying the results. Maybe then they'll get people to actually tune in.

Joe Biden will be president until noon on January 20. The Democrats will have the Senate until January 3. Both need to step up to the plate. Biden needs to flood aid and weapons to Ukraine, pushing the envelope on his legal authority. The Senate needs to work night and day to confirm every judge to district and appeals courts where openings exist.

@sandibachom Arkansans were shocked to learn that land had already been purchased for Sarah Huckabee Sanders' construction of a new prison. Nobody in the community was consulted, including the mayor. Makes you wonder if this is really meant to be a detainment camp.

The 2024 Election was hacked at the tabulation level. I have a 25 year career, finding and/or conducting such hacks. It's easy-ish to do. GOP/Trump-Putin/Musk all have the resources, motivation and access to do it. Hand recount the 2 oddest precincts in each county. Solved.

Twelve students at Salisbury University in Maryland are now facing assault and hate crime charges after they allegedly targeted a man “due to his sexual preferences” and lured him to an off-campus apartment where they beat him. The students, all men ranging in age from 18 to 21, are charged with first degree assault, false imprisonment, reckless endangerment, and associated hate crimes in connection with the October 15 assault. One of them met the victim on Grindr, pretended to be 16 years old and set a date to meet up “for the purposes of having sexual intercourse." The legal age of consent in Maryland is 16 years old. Once they lured the victim into the apartment, approximately 15 men appeared and assaulted him while using a homophobic slur, among other derogatory terms. The victim was finally allowed to leave and he suffered a broken rib and multiple bruises across his body. Two witnesses reported the incident to university police after one of the defendants showed them a video of the assault. According to the university, the arrested students have been placed on suspension.

Mark Elias sent out a mass email: “I was in New York City on election night in 2016. It was awful. As the general counsel to Hillary Clinton’s campaign, my job was to monitor and respond to legal issues that might arise on Election Day or afterwards. That night, as election returns came in, I was huddled with a group of other senior staff just down the hallway from the candidate and her family. By 10:30 p.m. we were nervous but still hopeful. By midnight the dawning reality of what was happening had set in. By 3 a.m., I was in an Uber back to my hotel knowing that it was over. Donald Trump had won. The next morning, Hillary gave a gracious concession speech. It was iconic in the way almost everything she does in a big moment is iconic. Towards the back half of the speech, she spoke the words that inspired me, and millions of others, to be a part of a movement that we did contemplate: I’ve had successes and I’ve had setbacks. Sometimes, really painful ones. Many of you are at the beginning of your professional public and political careers. You will have successes and setbacks, too. This loss hurts, but please never stop believing that fighting for what’s right is worth it. And so we need — we need you to keep up these fights now and for the rest of your lives. This call to fight would later become known as the “resistance.” But, at that moment Hillary was offering a guiding principle that was larger than Trump and his presidency. It was a perspective on politics and life. In good times and in bad, we were to continue to fight for what is right. After Joe Biden defeated Trump, we prayed the crisis had passed. Trump was a failed one-term president, tarnished by impeachment and a failed insurrection. When he was renominated, despite having been indicted, we hoped that America would see him for the unhinged con man that he is. Yet, Hillary’s words continued to echo in the background. As the 2024 election grew near, the nervousness was palpable. Trump was again sowing doubt in the elections. Republicans were attacking the right to vote in state legislatures and the courts. But along with fear, a feeling of excitement was also building. Momentum seemed on the Democrats' side. Republicans were losing in court. Election Day was largely uneventful — other than a series of false bomb threats aimed at disrupting Democratic voting precincts. Yet, as the returns came in, a feeling of dread set in. At around 9:30 p.m., I texted my wife: “It’s still close, but honestly feels a little like 2016.” As in 2016, by midnight the reality of the outcome had set in. Except this time, it was different. There was no mystery about what kind of president Trump would be. There was no question that he wanted to use the government to exact revenge against his enemies and enrich his friends. He had made his racist, authoritarian preferences more explicit and more well organized. Most chilling, it was clear he was going to win not just the Electoral College, but the popular vote as well. At 4 p.m. Wednesday, I turned on the television for the first time all day. I had been avoiding political coverage, but I wanted to see Kamala Harris offer her concession speech. She sounded a lot like Hillary, but more resolute and more specific: We will never give up the fight for our democracy, for the rule of law, for equal justice, and for the sacred idea that every one of us, no matter who we are or where we start out, has certain fundamental rights and freedoms that must be respected and upheld.” Continued in the next thread. 1/2

Speaking for myself, I feel abandoned by you and my government just as the people of Weimar must have. After 50 years of allegedly fighting for our democracy, you are capitulating to a Fourth Reich. They told us what they are going to do, and you are just letting them do it. Are you really going to be the Franz von Papen of the 21st century, Joe? You had the power to fix this. You should have had the information to understand the threat that we were facing. Instead you treated it like just another Democratic presidency, hoping that if the economy were good enough it would fix the problem with all the “MAGA extremists.” You were wrong. You didn’t listen to those of us who told you who tried to steal the election from you in 2020. You let your DOJ and FBI drag their feet with the perfect timing to let Donald Trump and his co-conspirators go free. You prosecuted all the foot soldiers and never went after the “generals.” You prioritized “norms” and the “independence” of the DOJ over us. You failed to lead, to demand accountability — from Merrick Garland, Chris Wray and the others who let this happen on your watch. I hear you talking now about “all that we accomplished” in your “historic administration” as if that will have any impact on the psychopaths who will destroy everything that you have done. You could have been the inflection point to preserve our world and make it better, instead you presided over a transition into an authoritarian global nightmare. To hear this is just a “setback” is insulting. You are leaving your nation to the wolves and you won’t even be honest about it. I put myself in the crosshairs for this country, Joe Biden, as did many patriots who fought alongside me. Instead of hearing us, you are just letting them pull the trigger. I have deep respect for you, Joe. I fought hard for you. But in this moment, as you gaslight us that it’s all going to be fine, my loyalty is shattered.

ATLANTA (AP) The letter sent by nearly two dozen computer scientists, election security experts and voter advocacy organizations asks for a federal probe and a risk assessment of voting machines used throughout the country, saying the software breaches have "urgent implications for the 2024 election and beyond." During World War II, we sent half a million young men to die to defeat a madman who was hell-bent on killing everything in his path. In 2024, it doesn't look like President Biden is even going to be willing to use the Justice Department to stop a madman from killing American citizens here at home. We'll see. If he won't, he'll be an accessory to crimes against humanity.
