West Bengal Elections | Calcutta High Court rejects the demands of TMC regarding counting. The Court upheld the validity of the decision requiring Central Govt./PSU employees as counting supervisors/assistants. Writ petition dismissed. •No interference with counting process. •Such appointment is within ECI’s discretion and not illegal. •Handbook provisions do not restrict selection to State employees. •Presence of micro observers, agents, CCTV etc. ensures transparency, making allegations speculative. •The Additional Chief Electoral Officer (ACEO) has valid authority under delegation provisions (RP Act). •Hence, the impugned communication is not without jurisdiction. •Court rejected apprehension that Central Govt. staff would act under political influence as: •Multiple stakeholders are present in counting halls. •Safeguards like CCTV and observers exist. •Allegations were mere apprehensions without evidence. •Interference during ongoing election process is discouraged. •Any grievance can be raised via election petition (Section 100, RP Act, 1951).
