I thought I'd never write a constitutional law paper but here we are. New paper coming out in 2027 in the Denver Law Review arguing that at least some third country removals are unconstitutional.

The US government has not publicly recognized this - at least to my knowledge. And it's not helpful that explainers don't do this either b/c as much pressure as US government puts on Mexico, the problem is much bigger than the pressure recognizes.

Because of this the problem for the federal government is much much harder to resolve. The organizations are just involved in many more markets, have many more income streams, have penetrated state and local governments more throughly.

While this piece is useful it also evinces a fundamental misunderstanding of the CJNG and the changing nature of organized crime in Mexico that makes it a much harder challenge than even this article (which already paints a complicated picture) recognizes

Three things: A) this has got to be one of the dumbest things I’ve heard in my life. B) even if true, it’s irrelevant. You can’t say policy outcome your way around the constitution. C) it really is the dumbest thing in a case that has attracted very dumb things.

.@JoshuaSteinman has submitted a national security-related amicus brief in the pending birthright citizenship case before SCOTUS. This is a critical angle that has gone largely ignored in discussion of the case. He writes in part: "With a round-trip plane ticket, a malign actor can send an expecting mother to the United States, receive mother and baby on return, indoctrinate and train the child, and then send the individual back to the United States to engage in espionage activity. That mechanism, for instance, stymies major advances in digital surveillance and biometric technologies that make it harder for undercover agents to remain anonymous and operate in the target country under a false identity." "...Thus, with an extremely modest financial investment and the passage of time, a foreign adversary can use geographically derived birthright citizenship to create a nearly undetectable human intelligence asset with no bonds of affection for his country of birth and carte blanche access to the United States. And as the example of Russia’s 'Illegals Program' shows, malign foreign actors are perfectly willing to make such long-term plays."
