במדינה מתוקנת, שופט עליון שנתפס במחדל כזה היה מתפטר מיד – לא מתמודד על תפקיד נשיא בית המשפט העליון. כשופט, הוא היה פוסל מכל וכל התנהלות כזו מצד נבחרי ציבור, אך כשהדבר נוגע אליו – לפתע הכללים משתנים. מערכת המשפט לא יכולה לדרוש אמון ציבורי כשהיא מצופפת שורות במקום להוקיע מחדלים. אם שלטון החוק אינו תקף גם לשופטיו – זו לא דמוקרטיה, זו אוליגרכיה משפטית.
