@ProfWBCarter Self defense is an affirmative defense. The defense does have to prove it. The fact that Karmelo caused the death was never in question or needing to be proved by the prosecution since Karmelo admitted it.

I have not yet read the full trial transcript. But so far, I do know this. Karmelo Anthony was entitled to a jury of his peers. He did not get that. On that ground alone, he is entitled to a new trial. Minorities are not interchangeable. The prosecutor’s reported proffered reasons for striking all black jurors —that they were teachers—appears to be pretext. Anthony needs a new lawyer on appeal and in a new trial. His trial lawyer allowed in opinion evidence that should have been struck. He also seemed unable to appreciate and counter the impact of racial overtones in that case. Those overtones are clear even on Twitter commentary as folks seek to paint Metcalf as having no culpability in what happened and Karmelo as a complete monster. The facts on how the matter escalated are more complicated than that. He and they had no such authority. They are also apparent in the statements that seek to deputize Metcalf and other kids with authority to remove Anthony. They had none and initiated the conflict. That does not mean they should have been killed but it means they have explaining to do. The lawyer for Anthony apparently did not require that explaining. It is fair to ask how the Anthony’s ended up selecting that lawyer. The trial judge must be disqualified in any new trial if he actually gave an interview about the case before the appeal was considered. He has negatively affected the appeal rights of the defendant. He should know better. He should also be disqualified if he has any relationship with the Metcalf side. In a criminal trial, the prosecution has the burden of proof beyond a reasonable doubt. The defendant does not have to prove he is not guilty. Those rules apply to everyone. They apply to Anthony.

Hunter uses the word “we”. As per witness testimony, Hunter was the initial aggressor then Austin then others. They “surrounded..created a U shape around Karmelo” and Hunter allegedly grabbed property of Karmelo. In the state of Texas, (Texas Penal Code § 19.02(b)(3)) says if in the commission of a felony leads to death, that entire group can be charged with felony murder including Hunter. Why were they not charged ?

Defense attorney Mike Howard is trying to pull off an inside straight to get the jury to acquit Karmelo Anthony. Under Texas law, he needs to prove ALL of the following to the jury: -Anthony had a right to be present at that location (Stand Your Ground Doctrine); -did not provoke the person against whom the force was used (Initial Aggressor Rule); -was not otherwise engaged in criminal activity at the time , such as carrying the knife on school grounds (Part of the Stand Your Ground Doctrine); -reasonably believed that deadly force was immediately necessary to protect against the other’s use or attempted use of unlawful deadly force (Reasonable Belief Doctrine); -and that the threat of unlawful deadly force (or serious bodily injury) was imminent (Imminent Harm Requirement) This is absolutely ludicrous.

Karmelo Anthony is getting cooked 🔥 in court today. Two kids who were under the tent when the altercation between Karmelo and Austin Metcalf happened have now testified. One witness said that Karmelo had his hand in his backpack and the kids thought he was bluffing about having a weapon and when Austin went to push Karmelo he stabbed him in the same motion. The other witness said it appeared as if Karmelo already knew what he was going to do. He said that it was a light shove. When asked if it looked as if Austin was trying to pick a fight he answered no. When asked if it looked as if Karmelo was trying to pick a fight he answered yes. This does NOT LOOK GOOD for Karmelo Anthony at all.

Why did Reckless Ben make the claim that he won a small claims court victory against the Bricks & Minifigs store when in reality the cases were dismissed? Two of the cases he didn't even file the paperwork correctly and served the wrong people. The judge dismissed those cases. He does have an active case against Joshua Johnson, but that case is still active and the trail is later this month. Why lie about winning the cases?

The Court Clerk has entered a DEFAULT against Frogan in the Ethan Klein lawsuit. She and her legal team failed to respond to the complaint. They ghosted the court, basically. This now moves to the Judge where Ethan is likely to file for a full default judgement and Frogan will be liable for full damages.
