Day two is underway of the International People’s Tribunal for Palestine is underway. Over a dozen witnesses have given testimony to the most horrific, inhuman crimes imaginable at the hands of the US-Zionist occupation. Collective punishment, deliberate targeting of entire families, intentional blockades of food and water, direct targeting of farmers and fisherfolk by airstrikes and settler mobs, and even direct evidence of systematic repression and silencing of Palestinian voices by other states in collusion with the Zionist government were presented to the jurors and attendees. The prosecutor’s case is made more clear by the hour: Israel is committing genocide, and through its destruction of the land and environment itself, it is committing ecocide. And the defendant’s table, the space offered for the accused to be present to hear the testimony and speak for their crimes, remains completely empty. The silence of complicity is a staggering scream in the face of the people of the world. Fuller details of the witness testimony will be made public after the passing of the verdict. Since the recent capture of El-Fasher by the RSF, at least 2,000 civilians were summarily massacred, while mass rape of women has been used as a patriarchal tool of war, encouraged from the highest levels of command. Over 25,000 people have fled El-Fasher since then. The United Arab Emirates (UAE), a willing US puppet in the Gulf region, has emerged as the RSF’s chief backer, supplying them with weapons, vehicles, and financial support. Only by confronting the imperialist system itself, most notably by confronting imperialism’s puppet governments that willfully act on its behalf, will we see an end to the war, genocide, and plunder that the people struggle so heroically to be rid of to this day.

YLBHI punya 5 catatan kritis untuk perkapolri nomor 4 tahun 2025 ini: 1.⁠ ⁠Peraturan ini merupakan level peraturan internal (Perkapolri) namun mengatur jauh mengenai legitimasi penambahan kewenangan untuk tindakan Upaya paksa yang berdampak pada pembatasan hak asasi manusia seperti penangkapan, penahanan, penggeledahan, penyitaan tanpa izin pengadilan hingga justifikasi penggunaan senjata api menggunakan peluru karet atau tajam yang beresiko mengancam hak atas hidup sebagai hak asasi manusia. Hal ini, semestinya menjadi bagian dari hukum materiil maupun acara dengan level pengaturan Undang-Undang yang merupakan kewenangan DPR dan Pemerintah bukan Kepolisian sendiri. Mengingat materi muatan peraturan Internal kepolisian semestinya hanya terbatas mengatur mengenai perihal administratif kepolisian (Pasal 15 ayat (1e) UU Kepolisian); 2.⁠ ⁠Peraturan tersebut tidak merujuk dan justru bertentangan dengan ketentuan peraturan perundang-undangan yang berlaku dan fundamental terkait penegakan hukum, seperti halnya UU No. 8 Tahun 1981 tentang Kitab Undang-Undang Hukum Acara Pidana ; 3.⁠ ⁠Perkap tersebut menambah kewenangan tindakan lain oleh kepolisian yang tidak dikenal dalam hukum acara pidana seperti istilah Tindakan, Tindakan kepolisian, aksi penyerangan yang tidak jelas parameter dan akuntabilitasnya. Ini akan berdampak potensial ditafsirkan secara subyektif dan rentan praktik sewenang - wenang/ penyalahgunaan kewenangan untuk pembenaran terhadap penggunaan kekuatan berlebihan oleh kepolisian khususnya senjata api yg mestinya menjadi pilihan tindakan paling akhir dengan situasi berbahaya; 4.⁠ ⁠Bahkan ironisnya, Perkapolri ini bertentangan dengan perkapolri lain khususnya Perkapolri No. 1 Tahun 2009 maupun Perkapolri No. 8 Tahun 2009 yang mengatur mengenai prasyarat penggunaan kekuatan maupun implementasi prinsip HAM dalam kerja kepolisian yang menegaskan bahwa penggunaan kekuatan senjata api mesti sangat hati-hati dan digunakan sebagai upaya terakhir untuk melindungi nyawa dan keselamatan publik dengan mengedepankan prinsip legalitas, nesesitas, proporsionalitas maupun kewajaran. Dengan Perkap ini, penggunaan kekuatan senjata api bahkan peluru tajam dipermudah ; 5.⁠ ⁠Tidak adanya mekanisme pengawasan dan akuntabilitas yang jelas dalam penggunaan Tindakan kepolisian dalam Perkap ini khususnya untuk Upaya paksa dan penggunaan senjata api seperti peluru karet atau tajam akan menjadi justifikasi impunitas praktik kekerasan dan brutalitas aparat kepolisian serta pelanggaran hak asasi manusia seperti halnya extra judicial killing (pembunuhan di luar proses hukum) yang selama ini kerap terjadi. Sepanjang tahun 2019 – 2024, YLBHI mendata sekitar 35 peristiwa penembakan aparat kepolisian dengan jumlah korban tewas 94 orang.

Dengannya, Bangsa Indonesia akan selangkah lebih dekat kepada kemerdekaan dan demokrasi sejati yang telah lama dicita-citakan. FREE, FREE, PALESTINE! LONG LIVE INTERNATIONAL SOLIDARITY!

Di sinilah kedudukan penting perjuangan Palestina. Kemenangan Palestina atas teror zionis berarti pukulan telak bagi dominasi AS di timur tengah, dan secara strategis melemahkannya. Kelemahan AS, adalah keuntungan bagi kita.
